Administrative Court Nullifies Decision and Orders Inclusion of Citizen with Visual Impairment in Special Needs Registry
The Administrative Court has nullified the General Authority for Special Needs’ decision to exclude a citizen with vision loss in one eye from their registry. The court ordered the authority to issue a certificate of moderate visual impairment and to provide him with all his rights and benefits.
Attorney Abdulaziz Arab stated that the court ruled in favor of his client, adhering to principles recently upheld by the Court of Cassation. These principles affirm that individuals with vision loss in one eye cannot be excluded from the special needs registry, and they deserve full rights equal to those who have acquired a moderate impairment over the years.
Arab also mentioned that his client had previously been referred to the Forensic Medicine Administration. The medical report confirmed that his client had vision loss in one eye and could sustain his life with the other eye. However, Arab emphasized that a person cannot meet all their needs with one eye and should not be compared to those without impairments.
He pointed out that the Constitution and law guarantee all rights, assistance, and healthcare for individuals with special needs. International agreements also recognize vision loss in one eye as a moderate impairment, which warrants the acknowledgement of specific rights, both tangible and intangible.
